Question: Is it Illegal to Have the Title of a Song the Title of a Book!?
I was wondering!.
I just recently named a novel I wrote "Remember the Name" and when I was searching through google to make sure that it was the only name of it's kind, I found a song called "Remember the Name" by Fort Minor! If I were to get this published, could I get sued!? I also realized that in the song some of the lyrics are:
This is ten percent luck, twenty percent skill
Fifteen percent concentrated power of will
Five percent pleasure, fifty percent pain
And a hundred percent reason to remember the name!
And the titles of my chapters have percentages in them! Like, the first chapter is "20% Pain" and it's like in the song!

"Heart-Shaped Box" was by Nirvana; about as popular as you're going to get!.
Nope, it's not illegal, unless there's a registered copyright on the title (which is very, very, very rare and typically not granted by the USPTO because it would deplete the general public's available pool of titles to choose from)!. Some books even name their chapters after song titles!. There was a movie (documentary) called "Amarillo By Morning" named after the George Strait song "Amarillo By Morning!." Think of all the books and songs titled "Come On Over!." It wouldn't make logical sense for the courts to enforce mandates like that!.Www@QuestionHome@Com
no!. there's this really amazing book called Heart-Shaped Box!. and there's a song by someone (really popular but i dont listen to them) called Heart-Shaped Box!. and the titles of the chapters all have to do with hard rock or something like that!.Www@QuestionHome@Com
No, it's not illegal!. Unless Fort Minor put a copyright on the Title, it's legal!. Just like some books have the same name!. (Twilight by Stephenie Meyer, Twilight by Elie Wiesel)
