Question: I worked as a model for a casino and the photos were used on a billboard without my permission or release !?
and now they dont want to pay how much am i supposed to be paid my agent is giving me a very low rate that doesnt sound right any help!?Www@QuestionHome@Com

If you signed the standard "Model Release" form you probably do not have a leg to stand on here!. Most model releases state that the image can be used in practically any type of advertisement including billboards,magazines, books, newspapers,flyers, TV ads or just about anything else!. They don't need any additional "permission" from you!.

You did however state that there was NO release signed!?!?!? I find that hard to believe because NOOOO ad agency would dare print it or use it for advertisements WITHOUT a release!. They already KNOW what the penalties are!.!.!.or could be!. Be sure to document this by taking lots of photos of the billboards!. You might need the evidence in court!. I believe that you MAY have a legitimate case for a lawsuit in court!. Better find an attorney and try to get a free consult!.Www@QuestionHome@Com

This is a matter of contract!. If you signed a contract of any kind, or waiver or release, the terms of that probably govern what they can do with your picture and how much to pay!.

If you didn't it is more complicated -- because you knew you were working as a model and posing and that they would want the picture for something, there is at least an implied contract to use your image for publiciity!. What did you think they wanted your picture for!? If you can point to something specific you were told, you may be able to get more money if they went ahead and used your image beyond that!. But if they didn't, a court would have to see what they thinkwas reasonable!. I think a court would think it reasonable to use your image on the billboard, so the only question is what an unknown model would usually be paid for such services, and my guess is not very much!. Your agent is probably telling you the straight story!.

But if you are really concerned, tell all the details to a lawyer!. The consultation won't cost you anythng!.Www@QuestionHome@Com
