Best Answer - Chosen by Asker: As far as I know (and this can change from year to year):

You have to be a member of the Academy to qualify for a nomination in the year you are nominated (you have to meet qualifications by having a certain amount of work and credit on qualifying films and paying dues which are like $200-$500 a year to join the Academy).

You have to be in a film that was in distribution by a U.S. distributor, in the physical year (not calendar year) of the Awards period and made in a "jurisdiction." Thus not all English films or Australian films may qualify for the American Oscars EXCEPT in the Foreign Film catagory.

You have to be nominated by your peers who are members in good standing (editors nominate editors, actresses nominate actresses).

The whole Academy then votes on those nominated.

They say hob-nobbing is important, but that's not an official requirement.

It's also said politics plays an important part, but that's not official either, although some say it is.

As an example, everyone acknowledges that Stanley Kubrick is an outstanding director and he didn't win for Lolita or Dr. STrangelove (and didn't even get nominated) nor for Sparticus, so when 2001 came along they made a silly rule to limit the nominees that year and thus only Kubrick got nominated for Best Special Effects and he won the award, his only Oscar.

Others who did the effects felt, well, hurt by that because they actually did all the effects and Kubrick just supervised, picked and choosed which to use.

It was the same with Spielberg who got passed over for The Color Purple so they gave him the Thalberg award and THEN he went off and did Shindler and got his Oscar for direction.

You don't get Best Picture for ET or Raiders of the Lost Ark. They aren't OSCAR pictures for the top awards. They win for music, sound, effects, editing.
