Adams appointed a number of Federalists as justices to lesser federal courts for terms of five years each!. The Senate conferred the appointments and Adams signed their commissions in the last hours of his term, the so-called midnight judges!. Several of these commissions were not delivered and the new president Thomas Jefferson had Madison withhold them!.

William Marbury asked the Supreme Court issue a writ of mandamus to force Madison to give him his commission!. He based his claim on a section of the Judiciary Act of 1787 that created the federal court system!. THe Supreme Court ruled the section of the Act conflicted with Constitution and was unconstitutional!.

Marshall based the Court’s opinion on the premise that the Constitution is the supreme law of the land!. Marbury could not be given commission!. It is significant because it establishes the Courts power to review laws and declare them unconstitutional if necessary!.
