The fact is that there are, fundamentally, two approaches to the rule of law!. One is the traditional English one (not British: Scotland has its own system) according to which only definitely harmful acts are forbidden: everything not specifically forbidden is allowed!.

The other is the European model, stemming from Napoleon's rule, according to which the State is the ultimate authority, and everything not specifically allowed is forbidden!.

In our system, there is (or used to be) a presumption of innocence: in theirs, if the examining magistrate decides you are guilty, you have virtually no chance of an acquittal, no matter what the facts!. In our system, the people choose their own rulers: in theirs there is a political elite recruited through exclusive State-run colleges, dedicated to preserving the power of the oligarchs!.

Now, the general trend of this and many previous treaties is to homogenise legal and political process throughout Europe - and the model has nothing to do with liberty, fair trials or democracy!. It is based on the French system of top-down rule, under which the individual citizen has nothing to do with the laws except to obey them!.

We have an economic and political union of 27 member states (plus a few more on the waiting list)!. We need some kind of framework to set out how things are organised!. The Treaty of Rome is over 50 years old and was written when there were only 6 member states!. It's creaking a bit and we need a new way of organising ourselves!. Just look at the latest "anti-terror" legislation to detain suspects for 42 days without being charged!.
