Question: Mother is deceased son is 21 yrs!. old does he consent to change from last name he has to mine!?
mother and I are not married!. DNA showed positive , he is my son!. His mom gave him another last name!. she is deceased, He and I would like to change his last name to mine!.Www@QuestionHome@Com

Simply changing his last name to yours, does not make him your son, legally!.
Contact an attorney, familiar with family law, and explain that you want to make him your son, legally!.
This will insure him of being your heir!.
A court-ordered DNA test may be required by the judge hearing your case!.

Remember, it takes more than a biological function to make a man a "dad"!.

Be a good dad and your son will learn by example!.
It's the best legacy you can pass on to your future generations!.

Here in the UK there is no need for a solicitor to be involved, it can be done through the Register office where the birth was registered, and costs £40:00!. Here in the UK 16 is the minimum age for a child to change their name without their parents consent!.

In Australia if you are 18 years or over you can apply for a name change!. Obtain an application form from The Registry of Births, Deaths and Marraiges in your state!. You need to submit certain documents and a fee!.
