Best Answer - Chosen by Asker: You might try reposting over in the law and ethics area, simply because a few lawyers tend to hang out there, and that would be a better perspective. Keep in mind.. they cannot give direct legal advice on which you would rely.. just possible opinions. Genealogists normally avoid giving information that would be considered violation of anyone's privacy.
While you need more, I will share some personal experience with you. Be extremely careful in posting personal names or statements online that could be taken as accusations. I speak up about situations... but cover my own posterior, since no names are involved.
Second, been there/done that with a grandchild custody dispute, except it was the other grandparents who did the taking. Identifying the HOME STATE of the child is what determines jurisdiciton (which state law applies). Father of the child is who has authority to initiate any legal actions, and it is dependent on what his legal status is/was at the time mom moved away. It can all get horribly complex.
Grandparent rights, enacted by many states, have been challenged as to being unconstitutuional. Google Troxel vs Granville, if you have interest in that- basically, unless a parent is PROVEN to be unfit... they have the right, even to withold from a grandparent. Not from the other parent. I watched other grandparent misuse "rights" - as well as commit perjury. Very sore subject with me.
Private investigators may be worth their weight in gold... but finding is only half the issue. You are welcome to drop me a private note via my profile if you like.
