Question: Okay, Here's a good one about getting permission about copy write materials already in publication!.!?
Here are my options as I see it at the moment!. I'm sure there may be others!.
(I want to get and I need to gain permission to use a selection that is already on the market)!.
1!. Find and get there permission!.
2!. Do it without their permission but give them their cited due credit!.
There seems to be a compensation question either one of getting credit or money because of someone such as myself who wants to use or is thinking about using others published materials!.

My question is !.!.!.If I can't find them (I'm sure I can) and use it anyway am I going to be sued!. I do not want to be sued!.Www@QuestionHome@Com

Do I understand correctly that you are not just referencing something in a term paper, but are planning to publish something containing others' copyrighted material!?

CAN you be sued!? Oh, yeah!. Using someone else's copyrighted material without consent constitutes theft of intellectual property!. Paul Simon got sued for merely using the copyrighted term 'kodachrome' in a song (and thereby providing Kodak with a great deal of free advertising)!. Even if you win the suit (and, for the moment, setting aside moral questions of right and wrong), that's a lot of legal fees!.

First, it is "copyright" (as in legal rights) not "copy write"!.

Second, whatever text you want to use was created by someone through hard work!. To use it without their permission is **stealing** what they created and yes, you could get sued or even jailed if you do that!. It is not about if money is involved, it is about if you stole someone else's creation for any reason!.

This also applies if you change the words but steal the ideas (like telling the same basic story but changing the character names and place names)!. That is called "plagiarism" and it is a crime!.

There is a concept called "fair use" but basically that applies to when you use a **tiny** portion of a book (maybe a paragraph or less) -- always with citation -- as part of some kind of review of the book or else as part of a new book or an school paper!.

Think of it this way!. If you were a sculptor who created a really great statue and someone came along and made little copies of that statue you would not be happy about that!. So why would a person who "sculpts" words feel different!?
