You mean a screen shot turned photo reference for original art!? The producer of the commercial paid someone to compose that image!. !. !. !. and if I were that producer (or the cinematic artist who shot it) I would not feel so generous as to consider it ok that you were using my image to create art that you would then claim to be your original idea!. Work product of every artistic type is copyrighted at its completion!. You certainly can use that image as inspiration, but take off in a new, fresh direction for your original art piece, and you will be on solid ground!.Www@QuestionHome@Com

The answer is yes and no!. The area of copyright and plagerism is very complex and there is never going to be a simple answer!. It could be considered a new original work of art even if you copied from another work like a commercial is it is transformative in nature!. Is what you are doing giving new meaning to the work or is the work simply being copied and exploited!.Www@QuestionHome@Com

Check out the artist Richard Prince, he re-photographed adverts and cropped them so there was no text, just a rather ambiguous image!.

Re-photographing or re-painting is a type of Appropriation, which is a large part of postmodernism!. Maybe it would help to research that a bit!.
