Question: Can I take a photo of someone without their permission!? !?
If in a public place, can I take a photo of one, or a group of people without their permission!? Does anyone know how the law stands on this!? What if I take a photo of an object, like a tree, and there are people nearby who I unintentionally include in the photo!? Www@QuestionHome@Com

If the photo is for editorial purposes then, no you don't!. If you plan to use it for publication or promotion then yes you do, and you will need to get a model release!. Boils down to HOW you are going to use the photo!. If you are going to profit from the sale of the photo then, you need a model release!. If not, then probably not, however it is a good idea to ask permission first, that is just being polite, and if they decline, again, be polite and abide by their wishes!. Some of the problems that we have today is from too many wanting to exercise their rights and then not wanting the responsibility that goes with those rights!. Ok, I am off my soap box!, For now anyway!

As others here have said In a public place for non-comercial reasons yes you can!. You cannot take pictures of them in places where they would have a "reasonable expectation of privacy"!. There are at times local ordinances that restrict you and property owners can prohibit you from taking pictures while you are on thier property!.

No, it's surely not illegal, it's just immoral!. And isn't manners!. However, you can still do it, they can't harm you in any way!. Like someone said if it was illegal, who would follow Brittany Spears around!? ( Papparazi would be out of business ) In some places it might be illegal, but not In the United States!. No i think that violation of piracy! I mean it all matters what you where going to do with it! It is totally normal if you were just taking pictures but if you were taking pictures to peak on other people that is not cool!Www@QuestionHome@Com
