Question:This guy is a street vendor and I want a picture of him selling on the street and then post it on a website that is talking about selling. Do I have to get his permission to do this? I mean, if he allows me to take the picture, then do I have to get a signed release so I can use it?

His image/likeness of him is a liability issue. If your boss doesn't want the CHANCE of a lawsuit, just get him to sign a model release before you use the picture.

Yes, you must have a release.

Yes you do and you need to pay him something ... you are getting value from using his photo, so you have to give him some kind of value in return

You do need a release, but you don't have to pay him anything unless the website is making you money.

If it isn't strictly editorial you should get a release. Money has nothing to do with it, he may find the publicity of equal value. ---edit--- You need to point this out in the release, that he is receiving the value of publicity. A release is a contract and some form of value must be exchanged for it to be a valid contract. ---end edit--- However, if you make money as a direct result of the photo you should give equal compensation. That is another reason for having a release, contact information.
