That's like asking which devil do I want to lead me!. This devil or that one!. The lesser of these two evils I think would be to let the guilty go free!. Www@QuestionHome@Com

Countries like the UK and the US would rather kill hundred of thousands of innocent to punish the guilty (their ex-friend Sadam)!. That's what they did in Irak before the war (US embargo killed half a million people, mainly children) and during the current war (thousands of civilians killed by bombs)!. So we live in a world dominated by people (the anglo-saxons) who believe in punishing the innocent!.

Punishment is generally seen as being ineffective in much of the research!. And if you are religious, that would be double jeopardy to be punished twice for the same crime -- once here and then in the after life!.

The question is a false dilemma, so no, I wouldn't agree that any person who is innocent should be punished!. When an innocent person is punished, they become embittered and have no reason to act in accordance with society!. Injustice only leads to more injustice!.

if you were jailed for 10 years for something that you didn't do, how much would you care about what happened to others!. Who knows, you might even consider revenge to make up for the wrongdoing that you experienced!.

When one ponders the riddle one knows that all were innocent!. When an innocent breaks a law of authority then one becomes guilty!. In this way of thinking only the guilty is punished!. The guilty loses his freedom!.

The innocent lives in freedom and only comes under punishment if one commits a crime!.Www@QuestionHome@Com

In the case of the innocent being willing to be punished or offering themselves to be, to be a marta, to protect someone else, for a greater cause, or as a story told to save our sins!.!.!. Then i would say the better of the two would be to punish the innocent!.

that just can't be answered without any contradictions
for society in general it would be better to punish any person that might be a threat
however, we are not always right in terms as who we perceive to be a threat

It depends on the severity of the punishment and the gravity of the crime committed by the guilty!. An innocent person may also be willing to take the fall for the guilty party, in which case it won't be as bad to punish the innocent!.Www@QuestionHome@Com

By letting the guilty go free are you not then punishing the innocent!? If that is the case then it would be the better of two evils to punish the innocent alone and in doing so keeping the guilty locked up!.Www@QuestionHome@Com

On balance I'd rather let some of the guilty go free therefore I believe that the criminal justice system should place heavy responsibility on the prosecution to put forward an airtight case!.Www@QuestionHome@Com
