assuming the seller is telling the truth that is it new, is this a good mouth piece to buy. I do by jazz with my saxophone, I am just making sure

Eh, it's an "okay" mouthpiece. I'd say it's a little better than a stock mouthpiece. If you're playing jazz and only jazz, I'd opt for a metal mouthpiece.
If you really want Vandoren, opt for the "Java" line. The mouthpiece you have listed is made of ebonite, which is not something I prefer because if you drop it once, it will most likely break.
My recommendation for a step-up mouthpiece is the Selmer C*.

If you bid on it, don't go higher than $10. Anything higher than $10, you can buy it in a music shop for the same price.

this is a lower mid range mouthpiece, sold stock on a lot of selmer mouthpieces, I would be wary. Its Vandoren, not vadoren.
