I'm not quite sure what you mean, but the first thing I thought of was the Dred Scott decision by the Supreme Court in 1856, which stated that slaves did not have the rights of U!.S!. citizens!. Scott and his wife, who had been living as a free man and woman, were returned to slavery!. I would say that at that time, a black man did not have the ability to combat an institution like the Supreme Court!.Www@QuestionHome@Com

Schenck v!. United States

In 1917, Schenck participated in antiwar rallies!. He was arrested under the Espionage Act!. The Supreme Court upheld the conviction unanimously!.
