Question:ok think about when u were in high school and u were stuck on this one thing that couldnt get u forward on ur other homework..and think about me in my situation and please help me out like when u needed help when u were in high school


anyway about marbury vs madison i get all the basic background information about how john adams appointed marbury then jefferson told madison not to carry out the commission but after that im clueless

so after that marbury issued a writ of mandus or w/e and what happend from there?

how did john marshall come into play at this time, he set up the judicial review why? who had a lot of power who was going to get more etc? what did it balance out

how did this case end up? what did the courts decide?

thats the only parts i do not get please help

Marbury v. Madison is the historical court case that set up judicial review. John Adams had appointed John Marshall right before he left office to serve on the Supreme Court. Marshall was a cousin of Jefferson. Marshall was a Federalist and Jefferson a Democratic-Republican. Marbury tried to sue the Maryland National Bank. Marshall shot this down saying that this was unconstitutional thus creating judicial review.

It was the case that established the power of federal judicial review of federal legislative and administrative actions. The Supreme Court asserted it had a Constitutional power to consider and resolve inter-government conflicts.The President and the Congress concurred.

well i doin the same so this was my answer:
John Marshall was the first supreme court justice to use the constitution to give a verdict. he justified under the supremacy clause that it was an implied power. Jefferson had no choice but to follow suit this set the precedent that the supreme court has power over the other two branches. the court decided that a writ of mandamus was unconstitutional. but it did start judicial review
