Question: Oliver Cromwel Confiscated lands from the Irish in the1660's, can the irish decendants re-claim the land!?
Best Answer - Chosen by Asker:
No!. Claims relating to land ownership are statute barred after 12 years!. (Statute of Limitations, 1957)!.

Even if they weren't, various land redistribution law from the late19th to mid 20th century gave grantees (i!.e!. recipients under those laws) of the lands good freehold title!.

These didn't affect every bit of land in Ireland, so some lands seized under Cromwell (no to mention the Tudors, the Stuarts and the Hanovers!) might still be held under titles derived from their expropriation!.

However, a claimant would have to
(a) somehow defeat the Statute of Limitations;
(b) show that they and not someone else is the rightful heir to the expropriated owner; and
(c) establish that no other heir in the chain back to the original expropriated owner had left a will giving all their title to the land to some other person!.

As nearly all wills have a residuary clause ("Anything else I own that I haven't specifically mentioned I leave to Mary"), it would be impossible to show that you and not someone else were the rightful owner!.Www@QuestionHome@Com

I do have ancesters that were forcefully moved by Oliver Cromwel's orders but, there is no claim I can make on that land today!. I don't think it would be fair to take someones property due to a tragedy that happened 300 years ago!.Www@QuestionHome@Com
