He is on the KY Death index as "Colonel"!.

I went to the LDS 1880,
http://www!.familysearch!.org/Eng/Search/f!.!.!.I searched for people on the US Census with first name "Colonel" and birth date 1870, (+/-) 10 years!. That date range would eliminate men who really had reached that rank in the military!. There were a couple of 20-year old colonels in the Civil War, but few or none in 1880!. I found 200+ men named "Colonel" aged 0 - 20!. The site returns 200 at a time!. I didn't look at the next 200!. You could!. This proves that "Colonel" is rare but not unknown as a first name!.

Sullivan v NY Times puts people like Charlie Manson in a different category than ordinary people!. Because of his notorious fame and well-biographied life, details of his genealogy are legitimately republished, even on this board!.
The answer to your question is that his father's legal name was indeed Colonel Scott!. It wasn't a military rank or honorarium!. In the wake of the Spanish-American War and WWI, it became common for children to be named after military ranks!. There are many men who went through the last century named Colonel, Major and Sargent (think Sargent Shriver)!. It was a naming fad!.Www@QuestionHome@Com
