My last remaining parent has died and i can't find a will?

Question:i am an only child, my mother died 7 yrs ago and dad inherited everything from her in her will,now he has died and i can't find his will ..can someone advise me please,do i inherit?

It will be dealt with according to the rules of intestacy.

A brief summary of these is that, when there is no Will, property goes to the nearest relative or relatives. The order of priority is a wife or husband, then children, then parents, then brothers and sisters and so on.

If you're in England, yes you will inherit everything through the rules of intestacy. You need to contact the probate office to obtain letters of administration. Then you can deal with the estate. If there's property involved, get a solicitor.

Find an estate or probate attorney and he will take it from there. You will have to file the estate, give it time for any claims to come in, and then eventually get the proceeds.

firstly, i am so sorry for your loss.

if your mum had a will and left everything to your dad then there must be a will somewhere as you would think they would have done a joint will originally. contact whoever dealt with your mums will.

you also need to be talking to a solicitor about this. i think some of them do the first consultation for free or a low cost of ￡25.

If your parents died intestate you and your siblings (if you have any) will have to go to a solicitor in order to get it sorted. They may be able to find out if a will does exist.

You need professional advice from a solicitor. You could visit the citizens advice bureau...they operate as a charity.

I think, if you're the sole surviving relative...and a will is not in existence...the answer is yes. However, I think I'm right in saying ...its a longer drawn out process when a will is not available...it goes through the probate process.

You need to take some proper legal advice...even if you paid for an hour of someones time...it would be worth doing...and start the process now...because in some cases...it can drag on.

When your mother made her will, did she use a solicitor?
It is likely that you dad made a will at the same time, though this would become invalid and would have been needed to be updated after her death.
If he did, then there is a chance that the will has been lodged with them.
Or ask at you Dad`s bank, some people give wills to banks for safe keeping.

So, have a look and see if you can find any reference to a solicitor, or you may have an idea which solicitor your mother used.

Don't forget people like to use banks to keep their wills for them.

Depends what country your in, if its the UK and theres no Will, then the govrnment gets most of it.
